- Will of Anthony Todd dated 18th April 1798 (Summary)
Unto my son-in-law, Earl of Lauderdale, all my household goods and furniture, plate, linen, china, pictures and books, stocks of wine and other liquors, horses, cattle, carriages, husbandry goods, garden and farming utensils, hay straw, corn and dung, which shall be at my dwelling houses at Walthamstow and at the post office, or other of them, or loaned out the time of my decease.
Unto my Trustees, my said son-in-law, the Earl of Lauderdale and my nephews, John Maddison and Michael Colling and relation, Anthony Parkin, all my Messuages and Lands, Tenements, Credits and Real Estate, situate, lying and being in the counties of Essex and Durham, in trust.
As to my Essex estate, to be by them sold and disposed of and within two years after my decease and as to my Durham estate, to be by them sold and disposed of when, at such time as they in their discretion shall think proper and the money to arise by such respective sale and sales, I direct to be taken as part of my personal estate.
Unto my nieces, Elizabeth Colling and Ann Brownless during their respective lives, the yearly sum of twenty pounds each by quarterly payments and I give and bequeath unto the three children of my said niece Ann Brownless, until they shall severally attain the age of twenty one years, the yearly sum of twenty pounds each, to be applied towards their maintenance, education and bringing up.
Unto my said nephews, John Maddison and Michael Colling, one thousand pounds each and I give and bequeath unto Daniel Braithwaite Esquire, Westgarth Snaith Esquire, John Bowden Esquire, Mr. Charles Godby and Captain James Maitland late of Jamaica, the sum of fifty pounds each.
Unto Mary Leyburn of Wolsingham and Ann Liddell daughter of Thomas Harrison of Dryburnside, during their respective lives the (??...) yearly sum of ten pounds each, by quarterly payments.
Unto my four Trustees the sum of one thousand pounds each and I give to each of my servants who shall have lived with me twelve months at the time of my decease, one years wages.
Unto Lord Casterton, a half part of the interest money that may be due from him unto me, up to the day of my death, upon condition that he shall and do pay the remaining half part of such interest, within twelve months after my decease and in failure, thereof , I revoke the said bequest, to give and declare that he shall be liable and called upon to pay the whole of such interest up to the day of my death.
My trustees to invest so much as shall be necessary, to pay one thousand pounds a year, in dual half yearly payments, to and for the benefit of my daughter, Lady Lauderdale during her life, from the day on which she may become a widow. And from and after the decease of my said daughter, will and direct that the said annuity of one thousand pounds shall be upon Trust for her eldest son and also to pay the sum of two thousand pounds to my said daughter in case she shall survive her said husband, within three months next after my decease.
The residue of my estate to be divided amongst all and every, the child and children of my said daughter if more than one, in equal shares and proportions which and as they shall severally attain the age of twenty one years. In case my said daughter shall so die without leaving any issue, then, Upon Trust, to pay all the remainder of my estate and effects together with all dividends and interest to arise and accrue therefrom to and equally amongst my two nephews, John Maddison and Michael Colling and my four nieces, share and share alike.
